Terms of Service

1. Agreement to Terms

By accessing or using Instaclaw ("the Service"), operated by Instaclaw ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Instaclaw is a managed hosting platform that provisions and manages OpenClaw instances on your behalf. The Service automates the deployment of cloud servers, networking tunnels, SSL certificates, and object storage to run OpenClaw — an open-source, self-hosted AI gateway. Instaclaw is not the developer of OpenClaw and does not control the OpenClaw software itself.

3. Account and Access

You must authenticate via Google OAuth to use the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Transmit malware, spam, or any content that is harmful, abusive, or unlawful
  • Attempt to gain unauthorized access to other systems or networks
  • Interfere with or disrupt the integrity of the Service
  • Use the Service for any purpose that violates the terms of the underlying AI providers (e.g., Anthropic, OpenAI) whose API keys you configure
  • Resell, redistribute, or sublicense access to the Service without our written consent

We reserve the right to suspend or terminate your access if we reasonably believe you are in violation of these terms.

5. OpenClaw and Third-Party Software

OpenClaw is open-source software licensed under the MIT License and is provided "as is" without warranty of any kind. Instaclaw deploys OpenClaw on infrastructure we manage, but we do not develop, maintain, or control the OpenClaw software. We are not responsible for bugs, vulnerabilities, or behavior within OpenClaw itself.

Your use of OpenClaw is subject to its own license terms. You are responsible for understanding and complying with those terms, including any restrictions on use.

6. API Keys and Credentials

The Service may require you to provide API keys for third-party AI providers (such as Anthropic or OpenAI). You are solely responsible for:

  • The security and proper use of your API keys and any credentials you configure
  • Any costs, charges, or usage incurred through those API keys, whether authorized by you or not
  • Complying with the terms of service of the respective AI providers

We store credentials only as needed to configure your OpenClaw instance. We do not monitor, log, or inspect the content of messages processed by your instance.

7. Infrastructure and Data

Instaclaw provisions cloud servers (via Hetzner Cloud) and storage (via Cloudflare R2) to run your OpenClaw instance. You acknowledge that:

  • Your instance runs on shared cloud infrastructure and, while isolated, is not equivalent to a dedicated security environment
  • Data processed by your OpenClaw instance (messages, configurations, logs) resides on infrastructure provisioned by us but is your responsibility
  • We use Cloudflare Tunnels for secure ingress — traffic is encrypted in transit, but you should evaluate whether this meets your security requirements
  • Upon deprovisioning, servers are destroyed but storage buckets may be retained briefly for recovery purposes before permanent deletion

8. Security

We take reasonable measures to secure the Service, including encrypted tunnels, token-based authentication, and isolated server instances. However, no system is perfectly secure. You acknowledge that:

  • Running an AI gateway that connects to messaging platforms inherently carries security risks
  • You are responsible for configuring your OpenClaw instance securely, including access controls, allowlists, and credential management
  • We are not liable for any data breaches, unauthorized access, or security incidents that arise from the use of your instance, misconfiguration, or vulnerabilities in OpenClaw or third-party software

9. Availability and Uptime

We strive to keep the Service available but do not guarantee any specific uptime or availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any downtime, data loss, or interruptions to your OpenClaw instance.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Instaclaw and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data, revenue, or profits
  • Business interruption
  • Costs of procuring substitute services
  • Unauthorized access to or alteration of your data or transmissions
  • Any damages arising from the use or inability to use the Service

This applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages. Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

12. Indemnification

You agree to indemnify, defend, and hold harmless Instaclaw and its operators from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of a third party, including AI provider terms of service
  • Any content or data processed through your OpenClaw instance

13. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We may also update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will make reasonable efforts to notify you of material changes.

14. Termination

Either party may terminate this agreement at any time. You may stop using the Service and deprovision your instances at any time through the dashboard. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately and we may delete your data after a reasonable retention period.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Instaclaw operates, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
